Terms of use

Version 1.0 · Last updated: 14 October 2026

These Terms of Use ("Terms") govern your access to and use of the website nibambe.com, its sub-domains, its AI tools (including the assistant "Jay" and the profile coach) and any related services (together, the "Platform").

The Platform is operated by CHAPUIS BRANDING AND CREATIVES LTD, a private limited company incorporated in the Republic of Kenya under the Companies Act, 2015, with its registered office in Nairobi, Kenya, trading as "Nibambe" ("Nibambe", "we", "us", "our").

Please read these Terms carefully. By creating an account, or by using the Platform in any way, you confirm that you have read, understood and accept these Terms and our Privacy Policy. If you do not accept them, do not use the Platform.

These Terms are an electronic contract. They are valid and enforceable under the Kenya Information and Communications Act (Cap. 411A) and the Law of Contract Act (Cap. 23).

1. Definitions

In these Terms:

1.1 "Account" means the account you create on the Platform. 1.2 "Client" means a person, business or organisation that uses the Platform to search for, contact or engage Creatives. 1.3 "Creative" means an individual or a Group that lists creative services on the Platform, including actors, models, photographers, videographers, makeup artists, singers, musicians, DJs, dancers, MCs, performers and designers. 1.4 "Group" means a dance crew, band, choir, troupe or similar collective listed under one profile, managed by a Group Leader. 1.5 "Guardian" means a parent or legal guardian, within the meaning of the Children Act, 2022, who creates and manages a profile for a Minor. 1.6 "Minor" means a person under the age of eighteen (18) years, as provided by Article 260 of the Constitution of Kenya and the Age of Majority Act (Cap. 33). 1.7 "Gig" means an opportunity for creative work posted on the Platform by a Client. 1.8 "Engagement" means any agreement made between a Client and a Creative, whether found through the Platform or not. 1.9 "Content" means any text, photos, videos, audio, CVs, portfolio items, reviews, messages and other material uploaded or submitted to the Platform. 1.10 "AI Features" means the automated tools on the Platform that use artificial intelligence, including search, ranking, the profile coach, gig checks and the assistant Jay. 1.11 "User" or "you" means any person who accesses or uses the Platform, including Creatives, Guardians, Clients and visitors.

2. What Nibambe is, and what it is not

2.1 Nibambe is an online directory and introduction platform. It helps Clients find Creatives and helps Creatives be found.

2.2 Nibambe is NOT:

(a) a party to any Engagement between a Client and a Creative;

(b) an employer, agent, manager or representative of any Creative;

(c) a private employment agency or recruitment agency within the meaning of the Labour Institutions Act, 2007 or the National Employment Authority Act, 2016. Nibambe does not recruit, place or deploy any person in employment, in Kenya or abroad;

(d) a payment service provider, escrow agent or bank. Nibambe does not hold or transfer money between Users.

2.3 Any Engagement is a contract strictly between the Client and the Creative (or the Creative's Guardian). The Client and the Creative alone are responsible for agreeing its terms, including price, dates, deliverables, deposits, cancellation, rights in the work, and payment. Nothing in an Engagement creates a relationship of employment, partnership, joint venture or agency with Nibambe.

2.4 We recommend that every Engagement is agreed in writing (a WhatsApp message or email is acceptable evidence) before work starts.

3. Eligibility and accounts

3.1 You must be at least eighteen (18) years old and have legal capacity to enter into a binding contract to open an Account.

3.2 A Minor may only appear on the Platform through a profile created and fully managed by their Guardian (see clause 6).

3.3 When you register, you must give your full legal name. Your legal name is kept private and is used for verification, safety and legal purposes only. Creatives may display a stage or professional name publicly. You must not use a stage name to impersonate another person or brand.

3.4 You must provide true, accurate and current information and keep it updated. Giving false information, including false identity or false credentials, is a breach of these Terms and may be an offence under the Computer Misuse and Cybercrimes Act, 2018.

3.5 You are responsible for keeping access to your email account, and therefore to your Nibambe Account, secure. You are responsible for all activity on your Account. Tell us immediately at support@nibambe.com if you suspect unauthorised use.

3.6 One Account may manage: its own Creative profile and up to two (2) Group profiles; or, for a Guardian, up to six (6) profiles of Minors. We may change these limits to protect the Platform.

3.7 You may not create more than one Account for yourself, or create an Account for another adult without their written consent.

4. Creatives

4.1 Your profile must describe you or your Group truthfully. Your portfolio must contain only work that you created or took part in, and that you have the right to show.

4.2 A Group Leader confirms that they are authorised by every member of the Group to list the Group and its members' names and roles, and to receive enquiries on its behalf.

4.3 You set your own prices and decide which jobs to accept. Prices shown on your profile are indications, not binding offers.

4.4 Contact details. You may list a main contact number and up to two (2) backup numbers. You confirm that each person whose number you list as a backup has agreed to be contacted by Clients about your work. Contact details are shown only to signed in Users.

4.5 Inclusion. Creatives may choose to share access needs or identity information (for example, that they are Deaf or use a wheelchair) in order to be matched with inclusive opportunities. This is always optional. You may hide it or delete it at any time. We treat it as sensitive personal data under the Data Protection Act, 2019.

4.6 Taxes. You are responsible for your own income tax, VAT and any other tax obligations to the Kenya Revenue Authority arising from your Engagements.

4.7 Nibambe never charges Creatives any fee to be listed, to apply for a Gig, to attend an audition or to be booked. Anyone requesting such a fee in Nibambe's name is not acting for Nibambe. Report it to support@nibambe.com.

5. Clients

5.1 You may use the Platform only to find Creatives for genuine, lawful work.

5.2 Gigs you post must be real, accurately described, lawful, and must state honestly the nature of the work, location, dates and pay (or that it is unpaid). Every Gig is checked by automated tools and may be reviewed by our team before or after it goes live. We may refuse, edit for safety, hide or remove any Gig.

5.3 You must not ask a Creative to pay you or any third party anything as a condition of being considered or hired.

5.4 You must pay Creatives as agreed in your Engagement. Nibambe is not responsible for any failure to pay.

5.5 "Verified client" label. Nibambe may, at its sole discretion, give the label "Verified client" after reviewing documents such as a company email domain, KRA PIN certificate or certificate of registration. The label only means that we have seen those documents at that time. It is not a guarantee of the Client's conduct, solvency or reliability. We may remove the label at any time.

5.6 You must not use Creatives' contact details for anything other than the opportunity you approached them about. You must not add them to marketing lists, sell or share their details, or contact them after they have asked you to stop.

5.7 Foreign opportunities. Any Gig that requires a Creative to travel outside Kenya must give full details of the employer or organiser, the destination, the work and who pays travel costs, and must comply with Kenyan law on recruitment for work abroad. We may refuse such Gigs. Any suspected trafficking will be reported to the authorities under the Counter-Trafficking in Persons Act, 2010.

6. Children (minors)

6.1 Protecting children is a priority. In all matters involving a Minor, the best interests of the child, as required by Article 53 of the Constitution and the Children Act, 2022, come first.

6.2 Only a Guardian may create, manage and publish a Minor's profile. By doing so, the Guardian confirms that they are the child's parent or legal guardian, and that they consent on the child's behalf to the processing of the child's personal data, as required by section 33 of the Data Protection Act, 2019.

6.3 All contact details on a Minor's profile must be those of the Guardian (and, for backups, other responsible adults known to the child's family). A Minor's own phone number, email, social media handle, school or home address must never be shown.

6.4 Minors' profiles are not visible to anonymous visitors; they are shown only to signed in Users.

6.5 Clients must deal only through the Guardian. A Client must never:

(a) contact a Minor directly;

(b) ask to meet a Minor without the Guardian present;

(c) request photographs or videos of a Minor other than through the Guardian and for a lawful, clearly described production purpose;

(d) offer work that is harmful to the child's health, education, safety or morals, or that is prohibited for children under the Children Act, 2022 or the Employment Act, 2007.

6.6 Any breach of this clause 6 will lead to immediate removal from the Platform and may be reported to the Directorate of Criminal Investigations, the Department of Children's Services or other competent authority. Offences under the Sexual Offences Act, 2006 and the Computer Misuse and Cybercrimes Act, 2018 (including child pornography and cyber harassment) carry severe penalties.

7. Rules of conduct

7.1 You must not use the Platform to:

(a) post false, misleading or fraudulent Content, Gigs or profiles;

(b) impersonate any person, Creative, brand or organisation, or Nibambe or its staff;

(c) request money, fees, deposits, M-Pesa payments, cryptocurrency or personal financial information as a condition of an opportunity, or run any scam, pyramid or "investment" scheme;

(d) harass, threaten, stalk, intimidate, discriminate against or abuse anyone, including by sexual requests or comments;

(e) publish hate speech or content that incites violence or ethnic contempt, contrary to the National Cohesion and Integration Act, 2008;

(f) post sexual or pornographic content, or arrange any sexual service;

(g) post links to external websites in profile text, spam, or mass unsolicited messages;

(h) collect, scrape or harvest data or contact details from the Platform by automated means, or use the Platform to build a competing database;

(i) access or try to access accounts, systems or data without authorisation, introduce malware, or interfere with the Platform's security or operation, contrary to the Computer Misuse and Cybercrimes Act, 2018;

(j) try to manipulate search results, the AI Features or the reporting system, including by writing instructions aimed at the AI in your profile, filing false reports, or using several accounts;

(k) infringe anyone's copyright, trade mark, image rights or privacy;

(l) do anything unlawful in Kenya or in the place where you are.

7.2 Safety reports. Every profile and Gig has a "Report" button. Reports must be honest. When several different Users report the same profile or Gig, it may be hidden automatically while our team reviews it. A profile hidden for review is not a finding of wrongdoing.

8. Content and intellectual property

8.1 You keep ownership of the Content you upload, including your photographs, videos, music and CV, subject to the Copyright Act, 2001.

8.2 You grant Nibambe a non-exclusive, royalty-free, worldwide licence, for as long as your Content is on the Platform, to host, store, copy, resize, display and distribute it on the Platform, and to show your public profile (stage name, photo, headline and portfolio) in Nibambe's own promotion of the Platform, including on social media. You may ask us at any time to stop using your Content in promotion, and we will do so within a reasonable time. Content already published in printed or past materials cannot be withdrawn.

8.3 You confirm that you own, or have the permission of the owner of, all rights in your Content, including the consent of any person who appears in your photos or videos, and, for any Minor shown, the consent of their Guardian.

8.4 The Platform itself, including the name and logo "Nibambe", the design, software, databases and text written by us, belongs to CHAPUIS BRANDING AND CREATIVES LTD or its licensors. You may not copy or use them without our written permission.

8.5 Copyright complaints. If you believe Content on the Platform infringes your copyright, write to support@nibambe.com with: your contact details, the work concerned, the link to the infringing Content, and a statement that the information is accurate and that you are the owner or authorised to act. We will act promptly, which may include removing the Content.

9. Ai features

9.1 The Platform uses AI Features to understand searches, rank results, check Gigs, help Creatives build their profiles and answer questions (Jay). Jay is an AI assistant, not a human; a person can be reached at support@nibambe.com.

9.2 Search ranking is based on relevance to the request only. Nobody can pay to be ranked higher in ordinary search results. If we introduce sponsored or featured placements in future, they will be clearly labelled as such.

9.3 The profile coach writes a summary of a Creative's profile from the information the Creative or Guardian gives, including any CV uploaded. The Creative is responsible for checking that the summary and any suggestions they accept are accurate. CVs are stored privately and are not shown to Clients.

9.4 AI Features can make mistakes. Results, rankings, summaries, answers and Gig checks are provided for convenience only. They are not professional, legal or financial advice, and they are not a guarantee that a Creative or Client is suitable, genuine or safe. Users must use their own judgement.

9.5 Where an automated decision significantly affects you (for example, a Gig being flagged or a profile hidden), you may ask for it to be reviewed by a person, in line with section 35 of the Data Protection Act, 2019, by writing to support@nibambe.com.

9.6 To provide AI Features, relevant information is processed by our technology providers, which may be located outside Kenya, under appropriate safeguards as required by the Data Protection Act, 2019. Details are in our Privacy Policy.

10. Privacy and data protection

10.1 We process personal data in accordance with the Data Protection Act, 2019, the Data Protection (General) Regulations, 2021 and our Privacy Policy, which forms part of these Terms.

10.2 Key points:

(a) your legal name, email and private contact details are never shown to the public;

(b) contact details on profiles are shown only to signed in Users;

(c) phone verification is done through WhatsApp only when you choose to start it;

(d) you have the rights set out in section 26 of the Data Protection Act, 2019, including to access, correct and delete your personal data, and to object to processing. To exercise them, write to support@nibambe.com;

(e) you may complain to the Office of the Data Protection Commissioner.

10.3 Clients who receive Creatives' personal data through the Platform are themselves responsible for handling it lawfully under the Data Protection Act, 2019.

11. Fees

11.1 At the date of these Terms, creating an Account, listing a profile, searching and contacting Creatives are free.

11.2 Nibambe may introduce optional paid features in future. Before you are charged for anything, the price and terms will be shown clearly and you will have to accept them expressly. No existing free feature will become paid without at least thirty (30) days' notice.

12. Verification and trust labels

12.1 Labels such as "Phone verified" and "Verified client" mean only that a specific check was completed at a specific time. They do not mean that Nibambe endorses, recommends or guarantees any User.

12.2 Nibambe does not carry out criminal background checks, does not check professional qualifications, and does not inspect the quality of any Creative's work, unless expressly stated.

13. Suspension and termination

13.1 You may close your Account at any time from your account page or by writing to support@nibambe.com.

13.2 We may, acting reasonably, hide Content, suspend or close an Account, or refuse service, with or without notice, if:

(a) you breach these Terms or the law;

(b) we receive credible reports that you pose a risk to other Users, especially to Minors;

(c) we are required to do so by law, court order or a competent authority;

(d) we suspect fraud or misuse of the Platform.

13.3 Where it is safe and lawful to do so, we will tell you why and give you an opportunity to respond. You may appeal any decision by writing to support@nibambe.com within thirty (30) days.

13.4 We may keep certain information after closure where required by law, to resolve disputes, to prevent fraud or to protect Users, as described in our Privacy Policy.

14. Disclaimers

14.1 The Platform is provided "as is" and "as available". To the fullest extent permitted by Kenyan law, we give no warranty that the Platform will be uninterrupted, error free or secure at all times, or that any Creative, Client, Gig or Content is accurate, lawful, genuine or suitable.

14.2 We do not control, and are not responsible for, the conduct of Users online or offline, the quality, safety or legality of any work, or the performance of any Engagement.

14.3 Nothing in these Terms excludes or limits any right you have as a consumer that cannot lawfully be excluded or limited, including under the Consumer Protection Act, 2012.

15. Limitation of liability

15.1 Subject to clause 14.3, Nibambe, its directors, employees and agents shall not be liable for:

(a) any loss arising from an Engagement or from dealings between Users;

(b) any loss of profit, income, business, opportunity or data, or any indirect or consequential loss;

(c) any loss caused by events beyond our reasonable control, including power or internet outages, failure of third party services, natural disasters, civil unrest or acts of government.

15.2 Subject to clause 14.3, our total liability to you for any claim arising from these Terms or the Platform shall not exceed the greater of:

(a) the total amount you paid to Nibambe in the twelve (12) months before the claim, or

(b) ten thousand Kenya shillings (KES 10,000).

15.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited under Kenyan law.

16. Indemnity

You agree to indemnify CHAPUIS BRANDING AND CREATIVES LTD, its directors, employees and agents against any claim, loss, damage, fine or reasonable legal costs (on an advocate and client basis) arising from: your breach of these Terms; your Content; your Engagements; or your breach of any law or of any third party's rights.

17. Disputes between users

17.1 Disputes between a Client and a Creative are for them to resolve. We encourage good faith discussion first.

17.2 Nibambe may, at its discretion and without obligation, help by reviewing reports, sharing safety information or taking action on Accounts under clause 13. Nibambe does not act as a judge or arbitrator between Users.

18. Governing law and disputes with Nibambe

18.1 These Terms are governed by the laws of the Republic of Kenya.

18.2 If you have a complaint about Nibambe, please write first to support@nibambe.com. We will acknowledge it within seven (7) days and try to resolve it within thirty (30) days.

18.3 If the dispute is not resolved, either party may refer it to mediation, including court-annexed mediation under the Civil Procedure Act (Cap. 21) and the Mediation Rules.

18.4 If mediation fails, the dispute shall be referred to the courts of Kenya, which shall have exclusive jurisdiction, save that either party may seek urgent interim relief in any competent court. Nothing in this clause limits a consumer's right to bring a claim in the Small Claims Court or to approach the Office of the Data Protection Commissioner or any other regulator.

19. Changes to these terms

19.1 We may update these Terms to reflect changes in the law, in the Platform or in how we operate. We will publish the updated Terms on the Platform with a new "Last updated" date.

19.2 For material changes, we will give you at least fourteen (14) days' notice by email or on the Platform before they take effect. If you continue to use the Platform after that date, you accept the new Terms. If you do not accept them, you may close your Account.

20. General

20.1 Entire agreement. These Terms, together with the Privacy Policy and any guidelines published on the Platform, form the entire agreement between you and Nibambe about the Platform.

20.2 Severability. If any provision is found invalid or unenforceable, the rest of these Terms remains in force.

20.3 No waiver. A failure or delay by us to enforce a right is not a waiver of it.

20.4 Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor in connection with a reorganisation, merger or sale of the business, on notice to you.

20.5 Notices. We may send notices to the email address on your Account. You may send notices to support@nibambe.com. Legal notices may also be delivered to our registered office.

20.6 Language. These Terms are written in English. Any translation into Kiswahili, French or another language is provided for convenience only; if there is any difference, the English version prevails.
